Electronic Invoice
For an invoice to be considered an “electronic invoice”, it is essential that it be sent directly from the seller system to the buyer. In other words, it is not enough to email a PDF invoice for it to be considered an electronic invoice!
In order to facilitate intra-community transactions, standardizing and simplifying contracts between member states, in 2014 a Standard was published, Directive 2014/55 / EU, which establishes the obligation for electronic invoicing in public procurement processes across the European Union.
The established deadlines are as follows,
Specific deadlines for Portugal:
– Until December 31, 2018, at the end of the year, the transition period provided for in the recent update of the Public Contracts Code (Decree-Law No. 111-B / 2017) ends, which anticipates the transposition of Directive 2014/55 /I. Thereafter, as of January 1, 2019, the total obligation applies: all contracts with the Public Administration must be invoiced in electronic format.

However, it is necessary that, by the end of November, an Ordinance be published with the transposition of the Directive to Portugal.
General deadlines in the European Directive:
– Until April 18, 2019, this is the deadline for Member States to transpose and implement electronic invoice obligations in public procurement processes.
– Until 18 April 2020, sub-central public entities (regional or local) can benefit from an extension of the deadline for the application of the Directive.
